Nintendo's updated "Game Content Guidelines for Online Video & Image Sharing Platforms" (September 2nd) significantly increase enforcement. Beyond DMCA takedowns, Nintendo can now proactively remove violating content and restrict creators from sharing future Nintendo game content. Previously, Nintendo only addressed content deemed "unlawful, infringing, or inappropriate." This update means creators violating guidelines risk a complete ban from showcasing Nintendo-related content.

While "unlawful, infringing, or inappropriate" covers a broad spectrum, Nintendo's FAQ provides examples. Two key additions to prohibited content are:

  • Actions impairing multiplayer gameplay, such as intentionally disrupting game progress.
  • Graphic, explicit, harmful, or offensive content, including statements or actions considered offensive, insulting, obscene, or disturbing.

These stricter guidelines follow reported takedown incidents. The revised measures, speculated to stem from a recent Splatoon 3 creator incident, aim to address offensive content.

Nintendo Removes Suggestive Splatoon 3 Video

Nintendo removed a Splatoon 3 video by Liora Channel. Uploaded August 22nd, the video featured interviews with female players discussing their dating experiences within the game, including encounters with high-profile players. Liora Channel stated on Twitter (X) that Nintendo deemed the content unacceptable, and they will avoid creating similar sexually suggestive content in the future.

These updates address the increased risk of predatory behavior in online games, particularly among younger players. Promoting sexual encounters in games aimed at a young audience can have serious consequences. Bloomberg reports numerous Roblox arrests involving individuals who abducted or abused victims met or groomed within the game.

Given content creators' influence, it's crucial to prevent Nintendo's games from being associated with harmful activities to protect young players.
